The Selling Process
The process of selling a property in Spain can be a little complicated if you have never sold a property before. STEP 1: VISITING YOUR PROPERTY
Casamona will come to visit your property and walk you through the sales process if you are unsure. During this visit, we can prepare a valuation report, if you have any doubts about the price.
We will also bring a photographer who will take pictures of the property, a video and a floorplan. Casamona will require that you provide a few documents, such as a copy of the energy certificate, the cedula and the last IBI paid, in order to list your property for sale.
STEP 2: PUBLISHING THE PROPERTY
After the visit, Casamona will publish your property on the Casamona website and on other national and international portals. We also have a large database with clients waiting for the right property.
After publishing the property we will send the link to you to check if everything is correct. It is important you check the description thoroughly so the potential buyer gets a clear picture of the property.
STEP 3: GETTING AN OFFER
When a potential buyer is interested in your property, they will make an offer on the property. To make an offer, the buyer will have to pay a fixed amount to reserve the property. The amount can either be 1% of the total price or 3.000 euros, depending on the price.
If you do not accept the offer, you can come up with a counter offer. However, if you do not reach an agreement with the potential buyer, the full deposit will have to be paid back. In case the two of you reach an agreement, the deposit becomes a reservation.
STEP 4: THE ARRAS CONTRACT
In case the offer is accepted, the Arras contract will be drawn up. The Arras contract is an official agreement between you and the buyer. There you agree on the purchase price and the details related to the process.
At this stage, you will receive 10% of the price (deducting the reservation cost) from the buyer. It is important to keep in mind that once the Arras Contract is signed you and the buyer are legally bonded. This means that if the buyer backs out of the agreement, they will lose the 10% of the buying price that they already paid. On the other hand, if you, the seller, back out, you will have to pay them twice the amount paid on the Arras i.e. 20% of the price. Sometimes buyers would like to pay this amount into an Escrow account. The buyer will have to pay the extra cost and legally there is no difference for you receiving the money.
STEP 5: SIGNING THE ESCRITURA
The buyer normally chooses the Notary. At this stage, the buyer has to pay the remaining amount. Casamona will email you a list of documents you need to provide and bring to the Notary. The buyer can make a bank transfer into your account directly at the time of signing.
Once the Escritura is signed, the ownership of the property is transferred to the buyers. You will give the keys to the buyer and you have to pay the ‘Plusvalia tax’, which you have 21 days to do. Casamona will help you transfer the utility bills to the new owner. You need to pay the agency fee to Casamona on the day of signing the Escritura.
