When you decide to sell your Flat:
The first thing you need to do when you are selling your flat is make sure your have the Cedula for your flat.
a. Decide when and what price you would like to have (but PLEASE be realistic).
b. Use an estate agent like Casamona.com who can and will advertise your flat on more than 30 different national and international sites.
c. Signing the Reservation. When Casamona has found the buyer, we will make a reservation with the buyer. They will have to pay 3000 Euros to reserve your flat and you will get 1500 Euros and can keep this money if the buyer decides NOT to buy your flat (which Casamona.com has never experienced). When buyers give us 3000 Euros, they will undoubtedly buy your flat!
d. Signing the Arras. Usually within five business days after signing the reservation, the buyer will need to sign a preliminary down payment contract called an "Arras". At this time they will pay around 5 to 10% of the purchase price. This legally binding contract clearly states the date of completion. Again, if the buyer changes their mind, this money is NON-refundable and is yours! If you change your mind you will have to pay the buyer the amount back plus the same amount as a penalty (so don't do this!).
e. Signing the Escritura. Finally, all parties (or their designated representatives) go to the notario? The public official appointed by the Spanish government to witness the signing of all legal documents. Here, the title deed (escritura) is signed. At this point you get the rest of your money and have now sold your flat.
